Who gets paid? New Colorado bill could change how families profit off kids online

COLORADO SPRINGS, Colo. (KKTV) -A Colorado bill that could change how families make money off social media content featuring their kids is moving forward at the State Capitol.

House Bill 26-1058 would require some parents who earn money from posts featuring their children to set aside part of that money for the child. The bill would apply to creators making at least $40,000 a year from that kind of content.

The bill would also require parents to track how often their child appears in posts and place a portion of those earnings into a trust the child can access when they turn 18.

State Rep. Meghan Lukens, one of the bill’s sponsors, said the goal is to keep up with a fast-growing online industry.

“We are seeing more kid influencers online, and their parents are making money off of that content,” said Lukens.

The bill also gives children the right to ask for certain content to be taken down once they become adults.

Supporters say the goal is to make sure kids are protected and get a share of the money they help earn.

But not everyone agrees.

“We find ways to pay our kids all the money that comes in. Our kids are saving and investing,” said Joe Evermore, a Colorado Springs father and social media influencer.

Still, Evermore said the bill could create more work for families like his.

“This just sounds like it’s going to be a lot of work. It just feels like more bureaucracy,” said Evermore.

The bill passed the House and is now headed to the Senate.
